Both the K1 Fiance Visa and CR1 Marriage Visa are good options for couples who wish to marry and live together in The United States. Which one is best for you depends on your personal circumstances. Here is a quick summary of the basic differences between the two:
- Faster processing times. Typically 10-14 months to obtain the Visa
- Can file as soon as you have met in person
- Considered a Non Immigrant visa (requires an Adjustment of Status after arriving the the US and getting married to become a Legal Permanent Resident and the right to work).
- A Co Sponsor can likely be used if it’s coming from a family member
- Only US Citizens can apply for their Fiances
- Longer processing times. Typically 18-24 months to obtain the Visa
- Must already be married to file.
- Considered an Immigrant Visa (already approved for Legal Permanent Residency and the right to work).
- A Co Sponsor is always allowed and can come from any Legal Resident of US Citizen (does not have to be a family member).
- US Citizens and Legal Permanent Residents can apply
You are welcome to call me anytime to discuss which visa would be best for you depending on your personal circumstances. You can reach me Toll Free free at 1-888-515-3529. During a phone call we can compare and contrast each visa and discuss which option is best for you. Issues of timing, possible need for a co sponsor, your need to travel on either visa after arriving in the US and your desire to work right away are all issues that are affected by each visa in different ways.
